      Dear Mr. Grindle,

I still have not received an answer to my mail of 2 January 2007, which is quoted below. I would have thought that a company that truly cares for its customers would have immediately taken the decision to make whole a customer who was unsatisfied for no fault of his. I purchased your product in good faith, believing it would work in a Mac environment since nowhere on your site is there any mention to the contrary. Now I know that you are legally bound to refund the price of the product itself. However, this is not simply a case of "customer dissatisfaction" but one where the customer was indirectly misled by lack of important information on your site. I would have thought therefore that you would have done two things immediately upon reading my previous e-mails: 1- immediately offer to refund ALL of my out-of-pocket expenses, and at any rate at least both outgoing and inbound shipping costs; 2- immediately updated your site to inform customers that your products are not Mac compatible.

I cannot believe that I'm the first MAC user who purchased your products in good faith, only to find out later that these are not Mac compatible. Unless you have stock in the particular company you use to ship your products, I fail to understand why you have not already updated your website to alert customers to the Mac-incompatibility of your products. After all, customers are the source of your profits. Furthermore, lack of clear statement of product compatibility on your site, or rather product incompatibility, may be viewed as contravening the legal requirement of "truth in advertizing" that all commercial enterprises are legally bound to comply with.

Naturally, the sums in question ($90 -for two way shipping- and $74 for French VAT I should have never paid) may seem too puny to warrant a legal action. However, this is a matter of principle, and therefore one that I feel bound to pursue through all means at my disposal, starting with a complaint to the Better Business Bureau, your local Chamber of Commerce, and a mass campaign to all relevant online forums.

I must however believe that you are a decent company, run by an equally decent management team. As such, I must believe that you will see the rightness of my request, and that you will make me whole on all expenses incurred: product cost, two-way shipping, and French VAT. This would turn what would have been letters of complaint into letters of praise. It's up to you to compare the value you can derive from a mere $164 refund (shipping and VAT) triggering a series of laudatory letters, with the value of sticking to the strict letter of the law, by refunding the cost of the product only, which would trigger a series of complaints to official and public bodies and forums.

A positive response within the next five business days would be highly appreciated. Failing that, I will return the unit as agreed under RMA number 59832-23713, and send out my series of letters as mentioned above.

I can only trust and believe that you will do the right thing, and not only the strict legal thing.
